Welcome to the website of Rebecca Hardy Antiques (“Rebecca Hardy Antiques”, “we”, “us”, “our”). By using this website and purchasing goods from us you agree to these Terms of Service. Please read them carefully before placing an order.
We may update these Terms of Service at any time. Any changes will apply to future orders and will be published on this page. These terms do not affect your statutory rights.
1. About us
Rebecca Hardy Antiques operates under sole trader status. You can contact us at hello@rebeccahardyantiques.com.
2. Making an order
To make an order on our website:
Add the items you wish to purchase to your shopping cart and proceed to checkout.
Confirm your order.
Payment will be handled via the secure payment provider via our website.
A contract is formed only when you receive our order confirmation email.
3. Price and payments
Prices listed on our website include all taxes.
We accept all major credit cards via our website.
Prices may change on the website but confirmed orders will remain unaffected.
4. Delivery
We currently deliver to UK mainland addresses only.
Delivery is included for all full priced items; otherwise, the cost is additional and calculated case by case, based on the size / weight of the item(s) and the destination address.
We aim to contact you within 48 hours of confirming your order to arrange delivery of your items. While we strive to deliver all orders within a week of arranging delivery, this is not guaranteed.
5. Returns and refunds
We want you to love your items as much as we do, so if you’re unhappy with something, please contact us using the email above as soon as possible.
To return an item, you must:
Email us within 14 days of receiving the item.
The item must be returned in the same condition as it was when delivered.
The cost of the return is at your own expense and risk. We can recommend couriers but accept no liability for damage caused during third-party transport.
We will process refunds to your original payment method within 14 days of us receiving the returned items. If the value of the goods returned by you is diminished by any amount due to your handling of the item, we may deduct a reasonable amount to reflect that damage from any refund.
We do not offer refunds on any non-prefabricated goods that are made on the basis of an individual choice or decision by you, or goods that are clearly personalised.
Unless expressly required by law we do not offer returns and refunds outside the 14 day window mentioned above.
6. Rental terms
We offer certain items for short-term rentals under the following terms:
Rental terms
Upon request, items may be loaned to customers for up to 5 working days, starting from the date of delivery.
The rental cost is 30% of the full retail price listed on the website, payable in advance.
A security deposit equal to 100% of the full retail price is payable upfront.
Upon safe return to us in original condition, 70% of the deposit will be refunded to you.
Condition, returns, and liability
All items must be returned in the same condition in which they were received.
Items will be inspected upon return, and any assessment of damage or diminished condition will be made at our sole discretion, acting reasonably.
If an item is damaged, lost, destroyed, or not returned, no refund will be issued, and you may be held liable for the full replacement value.
A daily late return fee may be charged if an item is not returned on the agreed return date. This fee is £50.
Risk and insurance
Risk and responsibility for the item pass to you upon delivery or collection and remain with you until the item is safely returned to us.
You are responsible for any loss, theft, or damage, including during transit or while in your care.
You must ensure that adequate insurance is in place to cover the full retail value of the item during the rental period. We may ask for proof of insurance.
Transport and handling
Delivery and collection of rental items are at your own cost and risk.
We can recommend couriers but accept no liability for damage caused during third-party transport.
Agreement to terms
A rental agreement must be confirmed in writing (including email) before the rental period begins.
By proceeding with a rental, you acknowledge and agree to these terms in full.
7. Important legal notice for antiques
Provenance & Authenticity
Descriptions are made to the best of our knowledge and belief. Unless explicitly stated, no representation is made that items are of a particular age, origin, or maker. We use phrases like “in the style of” or “attributed to” where necessary. Buyers should carry out their own due diligence.
8. Intellectual property
All content on our website, social media, promotional materials, emails and similar (including all images, text, logos, trademarks, layouts, graphics, photographs, images, videos, sounds, and any other design elements) are owned by Rebecca Hardy Antiques or our licensors. Nothing in these Terms of Use gives you any rights to use or copy these things without our express written permission.
9. Disclaimer and liability
We make every effort to ensure the accuracy of our listings, but we cannot guarantee that all information is complete or error-free.
Neither party limits or excludes its liability for death or personal injury caused by its negligence, for fraud, for sums payable under this agreement, or for any other liability which may not, by law, be excluded; and, if you are a consumer, your statutory rights will not be excluded or limited by these terms, except to the extent permitted by law.
Other than this, neither party shall be liable under or in relation to these terms (whether such liability arises whether such liability arises under contract, negligence, misrepresentation or otherwise) for any indirect, consequential or special loss any indirect, incidental, punitive, special, or consequential loss or damages of any kind.
Subject to the above, our total liability to you under or in relation to a contract to purchase products from our website under these terms shall not exceed the total amount paid and payable to us under that contract.
To the maximum extent permitted by applicable law and except as stated in these terms, all warranties and representations are expressly excluded.
10. Data protection
We will only use your personal data in accordance with our Privacy Policy or as otherwise agreed in writing or permitted by law.
11. General legal terms
Entire agreement. These Terms of Service, including any separate rental agreements, constitute the entire agreement between you and us in relation to the sale and purchase of our products and shall supersede all previous agreements between you and us in relation to the sale and purchase of our products.
Governing law. These Terms of Service and any orders placed through Rebecca Hardy Antiques shall be governed by and construed in accordance with the laws of England.
Assignment. We may transfer our rights and obligations under these terms. You may not do so without our written consent.
No waivers. No breach of any provision of a contract under these terms and conditions will be waived except with the express written consent of the party not in breach.
Severability. If part of these terms is found invalid, the rest will remain in force.
